REPRODUCCIÓN HUMANA ASISTIDA Y FILIACION EN EL
DERECHO DE FAMILIA COLOMBIANO

RESUMEN
La explosión jurídica en reproducción humana asistida, bien con fines
reproductivos, bien con fines investigativos; trae consigo una serie de
afectaciones de índole no sólo biológicas, afectivas, emocionales, sino también
éticas, sociales y jurídicas; toda vez que las técnicas de reproducción humana
asistida versan su fundamento en razón a la procreación del ser humano pormedios artificiales o técnicos, bajo el concepto de la dignidad humana y del
respeto ante la finalidad humana de reproducción o procreación, mediante el
fenómeno de la reproducción asistida.

Ahora bien, por razones ético-filosóficas, de doctrina, y limitaciones prácticas,
se reconoce que en nuestro país no existe una regulación legislativa sobre los
temas relacionados con las nuevas tecnologíassobre la vida, lo cual implica
que al no estar consagradas legislativamente las técnicas de reproducción

humana asistida, éste tema quedó bajo interpretación constitucional sobre el
“nasciturus” como protección de la “vida humana embrionaria” en Colombia.

En este orden de ideas, la reglamentación legislativa sobre las técnicas de
reproducción humana asistida y filiación en el Derecho deFamilia Colombiano,
ha tenido un desarrollo inverso, ya que primero se promulgaron las sanciones
penales para este tipo de prácticas, sin haberse dictado leyes relativas a las
técnicas de reproducción humana y al estatuto del embrión, a fin de establecer
sus límites, la responsabilidad que puede generar, tanto de carácter civil como
administrativa.

ABSTRACT

The juridical novelty in assisted human reproduction, as well with reproductive
objectives, as investigative objectives; brings a series of affectations not only
biological, affective, emotional, but also ethical, social and juridical; every time
assistedreproduction techniques put their fundaments in favor of the

procreation of the human being by artificial or technical means, under the
concept of human dignity and of respect before the human finality of
reproduction or procreation, through the phenomenon of assisted reproduction .

Now, for philosophical-ethical reasons, of doctrine, and practical limitations, it is
recognized that in ourcountry there is no legislative regulation on issues related
with the new technologies of life, which implies that assisted reproduction
techniques, by not being legislatively recognized, are under constitutional
interpretation on the “nasciturus” as protection of the “embryo human life” in
Colombia.

According to these ideas, the legislative regulation on the assisted reproduction
techniquesand filiation in the Colombian family law, has had an inverse
development, because penal sanctions were first promoted for this type of
practices, without having specified laws on the assisted human reproduction
and the embryo statute, with the objective of establishing its limits, the
responsibility it may create, both civilian and administrative.
