Resumen
El artículo plantea un examen general de la controversia entre dos grandes juristas,H.L.A. Hart y Ronald Dworkin, de gran importancia en la teoría del Derecho actual. Se inicia el trabajo con un examen de los diferentes tipos de positivismos, considerando la teoría de Hart comorepresentante del positivismo metodológico que sostiene que el Derecho es un conjunto de reglas primarias y secundarías, como forma de diferenciación entre Derecho y moral. Sin embargo, la posición de Dworkines contraria al concepto de Derecho como un sistema de reglas, considerando a los principios jurídico-morales, expresos o implícitos en el sistema jurídico, como lo más importante de lacaracterización del Derecho. A partir de esta diferencia en la definición del Derecho, se abordan las críticas que Dworkin realizó a la obra de Hart y la respuesta de éste en su “Postscriptum”.

Abstract
This article presents an overview of the dispute between two great scholars, HLA Hart andRonald Dworkin, of great importance in the current theory of law. The work begins with an examination of different types of positivism, considering the theory of Hart as a representative of methodologicalpositivism arguing that law is a set of primary and secondary rules as a way of differentiating between law and morality. However, Dworkin's position is contrary to the concept of law as a system ofrules, considering the legal and moral principles, expressed or implied in the legal system, as the most important characterization of law. From this difference in definition of law, the articleaddresses the criticism that Dworkin made to the work of Hart and the latter response in his "Postscript."
