RESUMEN

En materia de Derechos encontramos dentro de la historia colombiana dos referentes; la Constitución de 1886, mediante la cual se incorporó la tendencia universal a reconocer garantíasconstitucionales a través del Estado de Derecho. Por su parte, la Constitución de 1991 evolucionó a un modelo de Estado social de Derecho que integra el principio social, el democrático y el Estado de Derecho. En vigencia de la primera constitución predominaba la ley como herramienta de interpretación de derecho, en la segunda prevalecen los principios y valores constitucionales como instrumento deinterpretación y aplicación de la ley, por parte del Juez Constitucional a fin de darle vida al contenido orgánico de la Constitución. Los principios y valores constitucionales consagrados en la parte dogmática de la Carta, desarrollan los fines esenciales del Estado como hilos conductores de su estructura fundamental, de conformidad con lo previsto en el artículo primero superior. Los principios por sernormas de mandato, son normas que condicionan las demás normas, pero con mayor grado de concreción, pues alcanzan proyección normativa. Los valores por su contenido axiológico, irradian de manera indirecta el ordenamiento jurídico y marcan el derrotero a seguir en la garantía y aplicación de los derechos Constitucionalmente reconocidos.

ABSTRACT

In the field of rights we found within the Colombian history two concerning; the Constitution of 1886, which incorporated the universal trend to recognize constitutional guarantees through the Rule of Law. For its part,the 1991 Constitution has evolved a model of the social State of Law that integrates the social principle, the democratic and the Rule of Law. In observance of the first constitution prevailed the law as a tool for the interpretation of law, in the second prevailing principles and constitutional values as a tool of interpretation and application of the law, on the part of the constitutional judgein order to give life to the organic content of the Constitution. The principles and constitutional values enshrined in the declaratory part of the Charter, develop the essential purposes of the State as threads of its fundamental structure, in accordance with the provisions of article first superior. The principles to be rules of mandate, are rules which govern the other rules, but with a higherdegree of specificity, because they are achieving normative projection. The values for its axiological content, radiate in an indirect manner the legal system and mark the course to be followed in the guarantee and implementation of the constitutionally recognized rights.
