LOS RELATOS EN EL PROCESO PENAL: UNA COMPARACIÓN ENTRE LOS SISTEMAS INQUISITIVO Y ACUSATORIO VENEZOLANOS ABG. MARIA EUGENIA RICCIARDIELLO Mérida - Venezuela ricciardiello2001@yahoo.esResumen Este trabajo de investigación, de corte sociológico jurídico, refiere los resultados de un estudio comparativo entre los relatos que se presentan en el proceso penal venezolano, en el marco de los sistemas inquisitivo y acusatorio. Para ello, se procedió, por una parte, a la observación directa y externa de cinco juicios orales en el Circuito Penal de Mérida, tomando nota de todo cuanto seventiló en las distintas salas de audiencia donde se llevaron a cabo los mismos hasta el momento en que se dió lectura a la decisión por parte del juez; y por la otra, se llevó a cabo la lectura de cinco expedientes penales pertenecientes al antiguo sistema inquisitivo, y que actualmente llevan los tribunales de ejecución penales con sentencias definitivamente firmes. El trabajo de Scott y Lyman,así como el de Sykes y Matza, sirven de marco conceptual, ya que establecen toda una clasificación de los relatos. Los resultados refieren que el tipo de relato más frecuente en el sistema inquisitivo (expedientes escritos) es la justificación, y dentro de ella «la condena del condenador», la cual no resultó respetada o creíble para el juez en ninguno de los expedientes analizados, pues así seevidencia de las sentencias condenatorias resultantes de dichos procesos. Así mismo, La excusa resultó el tipo de relato más respetado en el actual sistema acusatorio (juicios orales). ACCOUNTS IN CRIMINALPROCEEDINGS: A COMPARISON OF THE INQUISITORIAL AND ADVERSARIAL SYSTEMS IN VENEZUELA Abstract This research project, in the area of the sociology of law, reports the results from a study of accounts in Venezuelan criminal proceedings, comparing the inquisitorial and adversarial systems. On the one hand, five oral trials in the Mérida Criminal Circuit were observed, and declarations at all hearingswere noted up to and including the judge’s decision. On the other, five criminal cases from the previous inquisitorial system were studied (cases for which, offenders are now undergoing their sentences). Given that they provide a rich classification of accounts, the work of Scott and Lyman and Sykes and Matza provide the conceptual framework for this study. The results indicate that the mostfrequent type of account in the inquisitorial system was the justification, and within that «condemning the condemner», although none of these accounts was believed by the corresponding judges, as evidenced by the subsequent conviction of each offender. By contrast, the excuse is the type of account most respected in the current adversarial system (oral trials). Additionally, the conceptual frameworkwas found to be insufficient for the analysis and it is recommended that future research on this topic broadens the theoretical framework.
