LEY DE VICTIMAS Y LA CONSECUENCIA DEL RECONOCIMIENTO DE CONFLITO ARMADO.
RESUMEN.
La promulgación de la ley de victimas 1448 de 2011 por parte del Congreso de Colombia como iniciativa del Gobierno Nacional ha conllevado a que se hayan cometido algunas errores jurídicos en la terminología aplicada en lo referente a establecer en el inciso primero del articulo tercero de dicha ley, que lasvictimas son aquellas personas que individual o colectivamente hayan sufrido un daño por hechos ocurridos a partir del 1º de enero de 1985, como consecuencia de infracciones al Derecho Internacional Humanitario o de violaciones graves y manifiestas a las normas internacionales de Derechos Humanos, ocurridas con ocasión del conflicto armado interno.
Los términos “conflicto armado” y “comoconsecuencia de infracciones al Derecho Internacional Humanitario” son conceptos y normas propias utilizadas por el Derecho Internacional Humanitario o Derecho para la Guerra aplicable a las partes legalmente reconocidas en verdaderos conflictos internos de conformidad con lo establecido en el artículo tres común a los cuatro Convenios de Ginebra del año 1949.
La utilización de los términosanteriores podrían conllevar al reconocimiento implícito por parte del Congreso y Gobierno colombiano del carácter político de los grupos armados ilegalmente y/o terroristas, ante lo cual estos grupos podrían tener reconocimiento político nacional e internacional, incluso tener embajadores en otros países y solicitar inclusive ayuda militar y compra de equipo militar.

La experiencia que nos ha dejado la historia, ha demostrado que en Colombia, llevamos varias décadas de afectación del orden público, pero especialmente hay algunas que sonmás relevantes que otras y que han generado muchas victimas en el país por parte de los grupos armados al margen de la ley.
Con la expedición de la ley de victimas 1448 de 2011, el Estado Colombiano busco que con esta ley se le diera reconocimiento a las presuntas victimas del conflicto armado de acuerdo con las normas del Derecho Internacional Humanitario.
