The Roman law refers to the legal developments and system which occurred in ancient Rome when the Romans adopted the Greek language in their system of government. This lawhelped as the base of legal practice over the years in Rome spreading to past colonies, and also Latin America. The law was applied to roman citizens tie to their religion andattributes of symbolism, formalism and conservatism. The concepts of the law fell under public law, private law, Roman status and litigation. It dealt with matters of obligations,property, persons and succession in the civil system. The Napoleonic code was the French civil code that was established under the rule of Napoleon dating back to 1804. The codestrongly influenced other countries systems of law as it was viewed to be successful in codification. It allowed freedom of religion and government jobs were handled by specificqualified people and there were no privileges accorded on basis of birth.
The English common law was originally developed for English feudal and local courts. England’s continentallegal systems are also referred to as civil law systems (Markesinis, 2002). It was a rigid system at first based on the system of writs. The doctrine of stare decisis is theprincipal that the courts follow precedent decisions by abiding and adhering to decided cases. It cannot be relied upon always because of cases that were hastily or contrary toprinciple therefore overruled. The United States uses the common law in its federal courts system and the principle of stare decisis is flexible in most constitutional cases. The lawin the U.S is divided into primary and secondary sources where the primary includes; legislation (statutes), case law, while secondary; legal journals and case law summaries.
