German clothing fastener cartels
For at least 10 years, manufacturers of zip fasteners, snap buttons, rivets, etc. in Germany collaborated in a cartel.
The Commission discovered evidence that theundertakings had taken part in one or several single and continuous infringements of Article 81(1) of the Treaty.
What article (81-89) was violated and why?
Article 81 of the EC Treaty:
* fixedminimum prices
* divided up customers
* exchanged sensitive information that would have remained confidential in a properly functioning market.
What was the EU commissions decision (fine?Remedies?)
In fixing the amount of the fines, the Commission took into account the gravity and duration of the infringements, as well as the existence of aggravating and/or attenuating circumstances
In2007 the Commission fined 7 companies a total of €328m.

Spanish textiles
The Spanishtextile program ran from June 2006 until 31 December 2008 and was not notified to the Commission.
What article (81-89) was violated and why?
Article 87 3c of the EC Treaty. The Commission opened adetailed investigation on November 13, 2007, as it had concerns about the possible accumulation of various measures offered by the program.

What was the EU commissions decision (fine? Remedies?)Competition Commissioner Neelie Kroes said: "After a thorough investigation, the Commission is convinced that the Spanish textile program does not unduly distort competition in the market"
The Spanishgovernment informed the Commission it intended to give an €800m public subsidy to support the Spanish textile and clothing sector.
