What is adoption?
The act of receiving legally own a child who is not biologically, to give affection and care to satisfy their spiritual and material needs.
Who can adopt?
Chilean marriagesor permanent resident aliens in Chile.
In their absence, Chilean or foreign spouses not residing in Chile.
A non-resident marriages in Chile or abroad, can apply for single people, divorced orwidowed, Chilean or foreign, permanently residing in the country. If there are several interested bachelors or widowers who meet similar conditions, the court will prefer to whoever blood relative of theminor, and failing, to anyone with personal care.
What general requirements must be met to be able to adopt?
a) In the case of spouses, must have two or more years of civil marriage, unless one orboth spouses are infertile, in which case do not require a minimum duration of marriage.
b) Applicants must be over 25 years of age and under 60, unless one of the adopters is ascendingconsanguíneo the adoptee, if not required in these age limits.
c) Have a minimum difference of 20 years with the adopted requirement that applies to the same previous exception.
d) have been assessed assuitable from the standpoint of physical, mental, psychological and moral, for the (Sename) or an organization accredited to him to develop adoption programs.
What children can be adopted?
Childrenunder 18 years:
a) whose parents can not take care of their care and express the desire to give it up for adoption before a judge.
b) They are inbred descendant of one of the adopters.
c) hehas been found that could be adopted by resolution of a judge due to any of the following causes:
That parents are physically or morally disqualified to exercise care.
That parents do not providepersonal or financial care for 2 months. This period is reduced to 30 days if the child (a) is less than 1 year. It is not sufficient cause the lack of financial resources.
