INTRODUCCION.
De forma indiscutible hoy por hoy existe una guerra iniciada por el estado de forma abierta contra el delincuente que se encuentra inmerso en el mundo delcrimen organizado, es una aparente guerra en la que no importa la apariencia jurídica, es decir en donde las garantías individuales y los principios estructurales de derecho pasan a otro plano., en donde el estado en el afán de procurar seguridad a sus ciudadanos contraataca a todos los individuos que persistan en la comisión de delitos que pongan en grave riesgo el orden jurídicoexistente así como sus diversos intereses incluyendo desde su permanecía hasta los miembros que lo integran, surgiendo así una reacción jurídico penal discutida y denominada como derecho penal del enemigo, el cual según Jakobs se caracteriza por ser de perspectiva futurista, con penas desproporcionadas, y en el que se suprimen garantías y derechos procesales 1, este tema tan controvertido en otros...
