EL ESTATUTO DEL JUEZ EN EUROPA1

RESUMEN

El estudio, partiendo del análisis evolutivo de la construcción de las bases mínimas del estatuto
del juez europeo, examina los aspectos más relevantes del estatuto del juez, analizando el papel
convergente que desempeñan las normas europeas, aun sin eficacia vinculante, las cuales se
proyectan en elámbito de los sistemas consuetudinarios y continentales, aproximando las bases
estatutarias de la función jurisdiccional. Con especial relevancia se examina la cuestión
relativa a la incorporación de las reglas de ética judicial en el estatuto del juez, elemento éste
que se erige como fundamental en los sistemas judiciales en crisis para recuperar el prestigio y
confianza pública en el ejercicio dela función jurisdiccional.

ABSTRACT

This study is based on an evolutionary analysis of the development of the minimum basis for the
statute of the European judge and deals with the mostimportant aspects of that statute, focusing
on the role played by convergent European standards. These standards, although not binding,
project themselves both on common law and continental systems bringing them closer as
regards the statutory basis of the judicial function. The paper also pays particular attention to
the incorporation of rules and principles of judicial ethics to the statute ofthe European judge,
a key element for judicial systems in crisis in order to regain the prestige and the public
confidence in the exercise of judicial functions.

ESTATUTO DEL JUEZ

Tras la II Guerra Mundial, se sucedieron diferentes declaraciones internacionales
tendentes a determinar un estatuto de derechos inherentes a la persona, las cuales sólo
podían materializarse en el ámbito de sistemas de justicia fiables con unas garantíasmínimas, donde los jueces presentaran una posición institucional y un estatuto personal
que garantizara su actuación independiente e imparcial en defensa de estos derechos
frente a los poderes públicos. En este sentido, se promulgó un bloque homogéneo de
normas que reconoce el derecho de cualquier persona a ser oído ante un tribunal
