RESUMEN
La investigación tuvo como objetivo general determinar lacalidad de las sentencias
de primera y segunda instancia sobre Otorgamiento de Escritura Pública, según los
parámetros normativos, doctrinarios y jurisprudenciales pertinentes, en el expediente
N° 03924-2007-0-1601-JR-CI-04, del Distrito Judicial de la Libertad-Trujillo. 2013.
Es de tipo cuantitativo cualitativo, nivel exploratorio descriptivo y diseño
transeccional, retrospectivo y noexperimental; para la recolección de datos se
seleccionó un expediente judicial de proceso concluido, aplicando el muestreo no
probabilístico denominado técnica por conveniencia; se utilizó las técnicas de la
observación y el análisis de contenido y se aplicó listas de cotejo elaborado y
aplicado de acuerdo a la estructura de la sentencia, validado mediante juicio de
expertos. Obteniéndose lossiguientes resultados de la parte expositiva, considerativa
y resolutiva; de la sentencia de primera instancia se ubicaron en el rango de: muy
alta, muy alta y muy alta calidad; y de la sentencia de segunda instancia en muy alta,
muy alta y muy alta calidad, respectivamente. Finalmente, las conclusiones son: la
sentencia de primera instancia se ubica en el rango de muy alta calidad, y lasentencia de segunda instancia en el rango de muy alta calidad.

The overall research aimed to determine the quality of judgments of first and second
instance on Grant Deed as regulatory parameters, doctrine and case law, in file No.
