Abstract. The protection of genetic data has been
faced, on the one hand, by its integration into the
concept of health or medical data, obtaining with
this assimilation a reinforcedprotection thanks to
their consideration as sensitive data; and, on the
other hand, through by the remission to specific laws
which frequently has lead to a decrease of the level
of protection. These different legal treatments have
determined that the current regulation of genetic data
oscillates between the reinforced protection of sensitive data and the lower level of protection of theconcrete applications.
This article defends the need of new rights -rights of
fourth generation- to regulate new situations derived
form the new biotechnologies, for example, the right
of physical self-determination and the right of informative self-determination. Regarding this last one,
this article argues in favour of a specific contents
which is –partly- different from the one used by thejurisprudence and the academy.
In addition to this, this work defends the need of
creating a unitary regulation of the genetic data. It

should be a legal frame that includes all their possible applications and that, while assuring their consideration as a specific category of sensitive data,
incorporates, when needed, modulations in the reinforced protection that should be granted to thesedata. These modulations should be in any case in
accordance to the interpretation of rights and freedoms in our judicial system.

1.1. Concepto

Desde su inicial identificación en 1868 , el ADN
(ácido desoxirribonucleico) se ha revelado como un
elemento de gran importancia en muy diversos as1 El ADN fue identificado inicialmente en 1868 por el biólogo suizoFriedrich Miescher, aunque su reconocimiento se debe a los experimentos realizados, en 1943, por Oswald Avery. En 1953, James Dewey
Watson, Francis Crick y Maurice Wilkins descubrieron la estructura
molecular del ADN, con la importante colaboración de la fisicoquímica
cristalógrafa británica Rosalind Franklin.

pectos de la vida humana. Es, quizá,desde finales de
la década de los ochenta cuando las técnicas de análisis del ADN se han hecho habituales en muchos
países y, entre ellos, en el nuestro, emergiendo convenios internacionales, acuerdos y legislación nacional sobre las diferentes aplicaciones de estos análisis.
La potencialidad aplicativa de los datos genéticos ha
alcanzado a diferentes áreas del Derecho, y se ha
convertido enun factor relevante en una pluralidad
de actividades relacionadas con la salud y la asistencia sanitaria, así como también en el ámbito policial
y forense, en la identificación de personas, en la
investigación de la maternidad y la paternidad y otras
relaciones de parentesco o en la lucha contra la mi2
gración ilegal .
Se han formulado muy diversas definiciones de
“datos genéticos”. Así,el artículo 2 de la Declaración Internacional de 3Datos Genéticos Humanos de
la UNESCO de 2003 entiende por tal toda “información sobre las características hereditarias de las
personas, obtenida por análisis de ácidos nucleicos u
