In thisproject we are going to try and explain the tourist contracts of transport and we are going to focus on the land transport of passengers.
First we are going to describe what a contract of transport is,which parts intervene in it, and the effects of the contract on them.
* Contract of transport: is one by which the carrier is obliged to transport from one place to another, persons or thingswith a given price.
* Personal elements:
Carrier: is responsible for the execution of the transport and the custody of the luggage given to him.
Traveller: person who celebrates the contract oftransport and who is going to be transported.
* Effects of the contract:
The carrier has the obligation of transporting the traveller from one place to another making sure that he does notsuffer any damage during the transport and that he makes it in favourable conditions.
The traveller has an essential obligation, which is the payment of the ticket. Also he must not cause any damage inthe vehicle in which he is transported.
* Rail Transport
The purpose of the General Conditions of Carriage for Rail Passengers is to ensure that uniform contractual conditions are applied tointernational and domestic passenger traffic by rail, in so far as this is feasible and appropriate.
The International Rail Transport Committee drew up these General Conditions of Carriage for RailPassengers and recommends that its members apply them.
The carriage of passengers by rail is subject to the provisions of:
- The Uniform Rules concerning the Contract of International Carriage ofPassengers by Rail.
- Regulation (EC) No 1371/2007 of the European Parliament and the Council of 23 October 2007 on rail passengers’ rights and obligations.
