El Estado no ha considerado los derechos sexuales y reproductivos de hombres ni de mujeres, ya que las normasemitidas sobre salud y planificaciónfamiliar se dan en función de una política de población que tiene como objetivo central, eliminar la pobreza.
Para el sistema jurídico peruano, prevalece el concepto de derecho a la vida entendidocomo función biológica y no como calidad de vida que ejerce la libertad y la voluntad de la persona, en este caso, la mujer.
