Tesis sobre los derechos humanos

ABSTRACT: It is necessary to focus on the main theoretical assumptions
that underlie the Declaration of Human Rights, specially on those that are
at present under controversial discussion in the field of philosophy. In this
paper, the author, according to the ideas of the different international
declarations on humans rights, sustainsthat human rights are not only a
positive juridical instrument, but also, and mainly, a high human achievement based on the discovery and recognition of the dignity and worth

inherent in the human person. Human Rights is the result of a very long
tradition of people who have fight in favor of human beings, in alí the
societies and in every moment of human history; they exist just becausepeople fxght for them and ask for their 11111 recognition. They are universal, and every government in the world have to protect them and promote a fuller observance of those rights. Human person is te central subject
of human rights; it is very confusing to speak of animals’ rights. The right
of people to self-determination, as a part of human rights, applies only in
the particular situations ofpeople under colonial or other forms of alien
domination of foreign occupation. Human rights also imply a high level
of duties and virtues, and the recognition that humans beings are mcmbers of a community that make possible to be a human person. Although
they focus on the social and political dimensions of human life, they are
looking also for the happiness of people, as long as they promotepeace,
democracy, justice, equality, rule of law, pluralism, development, better

formations are need if we want to live in a world ruled by human rights.

There is apractical problem that calís for our comniitment: to create tbe
social, economic, political and cultural conditions that make possible te

objectives the Declaration of Human Rights.

Voy a alejarme algo de lo que suele normal en artículos rigurosos: lenguaje comedido ynumerosas citas avalando y ampliando lo que uno defiende. En lugar de ello, procuraré emplear un lenguaje más contundente, con
afirmaciones más radicales propias de un estilo próximo al panfleto, y sin
ninguna cita, aunque sí con bastantes referencias implícitas y explícitas que
permitirán seguir la pista de los textos y las personas con las que mantengo
un diálogo sobre el tema desde hace yamuchos años.

El invento de un descubrimiento
Es habitual poner una fecha de nacimiento a los derechos humanos, bien
sea la de 1789, en el marco de la revolución francesa con su declaración de
los derechos del ciudadano, bien sea la del 10 de diciembre de 1948, en las
Naciones Unidas. Esta última es la que celebramos este año. Ambas fechas
son correctas y recuerdan momentos históricos muyimportantes. Sin embargo, pueden conducir a una conclusión no fundamentada: para algunas personas, los derechos humanos son una invención jurídica, con implicaciones
políticas y sociales, de una determinada cultura, la occidental, en un determinado momento de su historia. Algunos llegarán a ver en esa invención un
artificio ideológico con el que ocultar la real desigualdad de los seres humanos, yotros lo considerarán una manifestación más del imperialismo cultural
de occidente que no respeta las peculiaridades y diferentes sensibilidades de
otras culturas. En el mejor de los casos, al acentuar la idea de invención, se

estará defendiendo una concepción positivista del derecho según la cual sólo
existen derechos cuando son debidamente promulgados y se convierten en
leyes con capacidad...
