CONCEPTO
La jurisdicción emana de la soberanía, y como esta tiene por límite el territorio
sobre el que se ejerce, la sentencia soloproduce efectos jurídicos dentro de
ese territorio.
• DENTRO DE LA COMUNIDAD JURÍDICA EN QUE VIVEN LOS
PUEBLOS MODERNOS, NO ES POSIBLE DESCONOCER,
QUE ASI COMO LAS LEYES TRASPASAN LAS FRONTERAS
Y LOSJUECES SE VEN A MENUDO PRECISADOS A
APLICAR LAS DE OTROS PAISES, DE NO ACORDARSE A LA
SENTENCIA EFECTOS EXTRATERRITORIALES
DESAPARECERIA LA SEGURIDAD DE LOS DERECHOS,
PUES BASTARIA PARA ELUDIRLOSSUBSTRAERSE A LA
JURISDICCIÓN DEL JUEZ QUE LA PRONUNCIÓ.
EXEQUÁTUR: es el conjunto de
reglas conforme a las cuales el
ordenamiento jurídico de un Estado
verifica si una sentencia judicial emanada
de untribunal de otro Estado reúne o no
los requisitos que permiten reconocimiento
u homologación.
