RESUMEN

La investigación tuvo como objetivo general determinar la calidad de las sentencias de primera y segunda instancia sobre Desalojo por Ocupación Precaria según los parámetros normativos, doctrinarios y jurisprudenciales pertinentes, en el expediente N°561-2010-0-2501-JR-CI-05, del Distrito Judicial del Santa-Chimbote 2013. Es de tipo cuantitativo cualitativo, nivelexploratorio descriptivo y diseño transeccional, retrospectivo y no experimental; para la recolección de datos se seleccionó un expediente judicial de proceso concluido, aplicando el muestreo no probabilístico denominado técnica por conveniencia; se utilizó las técnicas de la observación y el análisis de contenido y se aplicó listas de cotejo elaborado y aplicado de acuerdo a la estructura de lasentencia, validado mediante juicio de expertos. Obteniéndose los siguientes resultados de la parte expositiva, considerativa y resolutiva; de la sentencia de primera instanciase ubicaron en el rango de: alta calidad, muy alta calidad y muy alta calidad, respectivamente; y de la sentencia de segunda instancia se ubicaron en el rango de: muy alta calidad, muy alta calidad y alta calidad, respectivamente.Finalmente, las conclusiones son: la sentencia de primera instancia se ubica en el rango de: alta calidad, y la sentencia de segunda instancia se ubica en el rango de: muy alta calidad.

ABSTRACT

The investigation had as general aim determine the quality of the judgments of first and second instance on Eviction forPrecarious occupation, according to the normative, doctrinaire and jurisprudential pertinent parameters, in the process N° 1995-475-0-0200-J-CI-39, of the Judicial District of Lima - Lima 2013. It's of quantitative qualitative type, exploratory descriptive level and transeccional, retrospective and not experimental design; for the compilation of information, it was selected from a judicialconcluded process, applying the sampling not probabilistic named technique for convenience, there was in use the techniques of the observation and the analysis of content and there were applied lists of elaborated and applied check of agreement to the structure of the judgment, validated by means of experts' judgment. There being obtained the following results of the explanatory part, considerate anddecisive; of the judgment of first instance were located in the range of: very high quality, medium quality and very high quality, respectively; and of the judgment of the second instance were located in the range of: medium quality, very high quality and very high quality, respectively.
