INTRODUCCION

DERECHO DEL TRABAJO
Es el conjunto de normas relativas a las relaciones que directa o indirectamente derivan de la prestación libre, subordinada y remunerada de servicios personales y cuya función es producir el equilibrio de los factores en juego, mediante la realización de la justicia social.
En su estructura general, el derecho del trabajo abarcalas siguientes disciplinas:
a) El derecho individual del trabajo que comprende, a su vez, la autonomía privada en las relaciones laborales; las condiciones generales de trabajo y los regímenes especiales de trabajo.
b) La previsión social, dentro de la que se incluye el trabajo de mujeres, el estatuto laboral de los menores, el derecho habitacional, el régimen sobre higiene y seguridad, lacapacitación profesional y los riesgos de trabajo.
c) El derecho sindical que incluye la organización profesional, el pacto sindical o contrato colectivo de trabajo y el derecho de huelga.
d) La administración laboral que comprende la naturaleza, organización y funciones de las autoridades del trabajo, y.
e) El derecho procesal del trabajo.
Como ordenamiento que atiende a las personas como bienfundamental y aspira a su mejoramiento moral y espiritual, el derecho del trabajo se considera como una subespecie del llamado derecho social.
Una corriente doctrinaria, atendiendo al carácter clasista, esencialmente proletario del derecho del trabajo, le atribuye dos fines esenciales:
