" SOBRE ALGUNOS ASPECTOS FUNDAMENTALES DE LA INTERPRETACIÓN CONSTITUCIONAL: ENFOQUES O MÉTODOS INTERPRETATIVOS." Ronald Chacin Fuenmayor. Profesor de la Universidad del Zulia. RESUMEN La actividad interpretativa es de vital importancia para el desenvolvimiento del Derecho y dentro de ésta destaca la interpretación constitucional, en virtud de la fuerza normativa de la Constitución, cuyaaplicación se constituye en eje fundamental para la preservación del Estado de Derecho, especialmente en Venezuela, cuya Constitución es de reciente vigencia, por lo cual urgen pautas teóricas para su interpretación adecuada, por consiguiente; se hace un análisis crítico sobre los principales enfoques considerados por la doctrina en el proceso de interpretación constitucional. La metodología utilizadaconsistió en una investigación descriptiva, empleando como técnica una amplia indagación documental sobre la doctrina de interpretación constitucional en el área anglosajona, de Europa continental, e Ibero América, para el logro del siguiente objetivo: Explicar los fundamentos utilizados por los enfoques de interpretación constitucional. Se discute sobre las dos principales tesis de los enfoques parael manejo de los aspectos propios de la interpretación Constitucional: la formalista, que reduce la interpretación de la Constitución al análisis de categorías lógico formales (normas positivas), y la material, que se centra en los valores éticos presentes en el texto constitucional. Concluimos sobre una posición intermedia entre las dos posturas, concretamente en la necesidad de un enfoqueaxiológico en el proceso de interpretación constitucional, del cual dependan el tratamiento de los aspectos constitucionales (principios, fundamentos y problemas de la interpretación constitucional), para una aplicación adecuada de la Constitución, es decir, más acorde con los valores jurídicos, siempre y cuando estos elementos axiológicos se desprendan del contenido de la Constitución analizada, a losefectos de evitar la arbitrariedad o subjetivismo denunciado por la postura formalista. Thus, theoretical guidelines for their suitable interpretation are urgent, therefore; a critical analysis becomes on the main approaches considered by the doctrine in the process of constitutionalinterpretation. The used methodology consisted of a descriptive investigation, using as technical and a wide documentary investigation on the doctrine of constitutional interpretation in the Anglo-Saxon area, continental Europe, and Ibero-America, for the profit of the following objective: To explain the foundations used by the approaches of constitutional interpretation. It is discussed on two mainapproaches for the handling of the own aspects of the Constitutional interpretation: the formalist, that reduces the Constitution interpretation to the

analysis of formal logical categories (positive norms), and the material, that it's centered in the present ethical values in the constitutional text. We concluded on an intermediate position between the two positions above, in the need of anaxiological approach in the process of constitutional interpretation, which principies depend on the treatment of the constitutional aspects (foundations and problems of the constitutional interpretation), for a suitable Constitution application according with the legal values, as long as these axiological elements come from the content of the analyzed Constitution, with the effect of avoiding the...
