RESUMEN.
La indemnización sustitutiva no es más que una prestación económica que se reconoce a los afiliados al Régimen de Prima Media con Prestación definida, cuando éstos no reúnen el número mínimo de semanas cotizadas pero han cumplido la edad mínima paraacceder a la pensión de vejez y declaran la imposibilidad de continuar cotizando al Sistema General de Pensiones, dicha figura, permite que muchos cotizantes puedan acceder a este beneficio prestacional de carácter económico, pero en nuestra realidad imperante muchos colombianos se les ve mermado este derecho de envergadura constitucional porque las entidades que son encargadas para realizar dichostramites consideran que no cumplen con los requisitos cuando reposan en sus base de datos la información que los acredita para acceder a él; es precisamente con el fin de lograr la salvaguarda de estos derechos se introdujo en la constitución, mecanismos más directos con el fin de permitir la participación ciudadana, la defensa de los derechos y el control de las instituciones, este mecanismo alcual hacemos alusión es la llamada y reconocida ACCIÓN DE TUTELA, siendo una institución procesal objeto de estudio en esta oportunidad. La acción de tutela entonces, surge como un mecanismo efectivo para la protección de las garantías constitucionales de libre acceso, con procedimientos breves y sumarios; teniendo en cuenta que es un mecanismo subsidiario y por tanto las entidades deberíanaplicar la normatividad vigente para por fin evitar que los cotizantes acudan al aparato jurisdiccional.

The payment in lieu is not an economic benefit conferred on members of the average premium scheme with Defined benefit when they do not meet the minimum number of weekly contributions but have reached the minimum age to access and state pension age the inability to continuecontributing to the general pension system, the figure, allows many contributors can access this social benefits of economic benefit, but in our current reality many Colombians them this right is diminished constitutional significance because the entities that are responsible to perform such formalities consider not qualify as rest in their database the information that credits to access it, it isprecisely in order to ensure the protection of these rights was introduced into the constitution, direct mechanisms in order to allow participation, rights and control of institutions, this mechanism which we refer is called and recognized CARE ACTION, being a procedural institution under study at this time. The tutela then, emerges as an effective mechanism for the protection of constitutionalguarantees of free access, with brief and summary procedures, taking into account that is a subsidiary mechanism and therefore entities should apply current regulations to finally avoid that contributors come to the judicial apparatus.
