RESUMEN

La dinámica de pruebas se manifiesta en actividades específicas llamadas actos de pruebas, que en el derecho procesal penal son elementos de obligatorio cumplimiento para dar inicio al proceso originado por una acción punible. Durante lainvestigación correspondiente al hecho punible interviene primero el denunciante ó víctima del delito, el Ministerio Público como titular de la acción penal, algunos terceros como testigos, cuerpo de investigaciones competentes, peritos y otros que podrían involucrarse y el imputado que es el sujeto procesal activo sobre quién va a recaer la acusación orientada por el representante del Ministerio Público.La interposición de una denuncia constituye un acto de prueba, también el dictamen de peritos, el testimonio, las diligencias practicadas por el cuerpo de investigaciones, la inspección, el levantamiento de cadáveres, comprobación de lesiones, objetos, daños, entre otros. Las pruebas facilitan al Ministerio Público el fundamento jurídico para sus determinaciones. El Ministerio Público perseguiráel delito cuando los elementos probatorios le proporciones un índice considerable de verdad, de lo contrario desvirtuaría sus funciones. Las pruebas son el medio indicado para justificar una postura legal, ya sea con el ejercicio de la acción penal o cuando se determina que el acto cometido lesiona los derechos humanos jurídicamente protegidos. El Código Orgánico Procesal Penal como instrumentolegal en la legislación penal venezolana constituye un cambio en el proceso que hoy se sigue en el País. Este instrumento legal contiene un aparte sobre el Régimen Probatorio fundamentado en principios y garantías constitucionales que enmarcan sus normas legales. La investigación presentada de tipo documental ha sido orientada en función de los fundamentos legales y conocimientos doctrinadosreferidos a prueba. En general se enfoca lo relacionado el medio probatorio en la legislación penal venezolana.

ABSTRACThe dynamics of tests is manifested in activities specific called acts of tests that are elements of obligatory execution to give beginning to the process originated by a punishable action in the right procedural prison. During the investigation corresponding to the punishable fact it intervenes the informer or victim of the crime first, the Public Ministry as regular of the penal action, somethird as witness, body of competent investigations, experts and others that could be involved and the one imputed that he/she is the fellow procedural asset on who it will relapse the accusation guided by the representative of the Public Ministry. The interference of an accusation constitutes a test act, also the verdict of experts, the testimony, the diligences practiced by the body ofinvestigations, the inspection, the rising of cadavers, confirmation of lesions, objects, damages, among others. The tests facilitate to the Public Ministry the juridical foundation for their determinations. The Public Ministry will pursue the crime when the probatory elements really provide him a considerable index, otherwise distort their functions. The tests are the suitable means to justify a legalposture, either with the exercise of the penal action or when it is determined that the made act injures the human rights legally protected. The Penal Procedural Organic Code as legal instrument in the Venezuelan penal legislation constitutes a change in the process that today is continued in the Country.
