RESUMEN

Uno de los problemas que se han desarrollado en la actualidad son los juicios largos motivo por el cual tenemos que enfrentar desafíos intelectuales, económicos, sociales, políticos que nos permitirá desarrollar mayor capacidadpara servir con inteligencia; la insumisión al arbitraje en materia laboral es una figura jurídica la cual está contemplada en nuestra Constitución de 1917, así mismo en la ley Federal del Trabajo se encuentra en el artículo 947 sin embargo esta figura se deja a la interpretación de cada autoridad de trabajo, ya que no establece el procedimiento para hacerlo valer, sin embargo la mayoría de losabogados están abusando de esta figura jurídica para obtener mayores ingresos despojando de los bienes al patrón. Para su estudio el autor recurrió a investigación documental y así definir si la promoción de esta figura jurídica tiene limitantes perjudiciales en relación a los sueldos caídos, las innovaciones en materia jurisprudencial. En la actualidad desafortunadamente en materia laboral haymuchos casos en los que se ejerce, por personas que no son abogados sino por individuos que se dedican a la gestión sin contar con los conocimientos jurídicos porque no son abogados, los trabajadores que fueron despedidos deberían ser asistidos y representados por un estudioso del derecho con cédula profesional y no permitir que por personas sin conciencia sigan desvirtuando, desacreditando ydesprestigiando esta noble profesión, debemos recordar que los pilares fundamentales deben de ser honestidad, formación académica y la calidad del servicio.

ABSTRACT

One of the problems that have developed in lengthy trials today are why we have to face intellectual challenges, economic, social, political willenable us to develop greater capacity to serve with intelligence insubordination in labor arbitration is a legal concept which is referred to in our Constitution of 1917 itself to the Federal Labour Law is in article 947 but this figure is left to the interpretation of each authority work, and it does not establish the procedure to enforce it , but most lawyers are abusing this legal to earn morestripping of assets to the employer. For their study, the author turned to documentary research and define whether the promotion of this legal concept has limitations in relation to harmful lost wages, innovations in jurisprudence. Today unfortunately many labor cases in which it is exercised, by persons who are not lawyers but by individuals who engage in management without the knowledge of the lawbecause they are not lawyers, workers who were laid off should be assisted and represented by a legal scholar with professional license and not allow unscrupulous people to continue distorting, discrediting and debunking this noble profession. In the foregoing we must remember that the pillars should be honesty, scholarship and service quality.
