Teoría del Delito
Es una herramienta conceptual con la que cuentan los juristas, la misma consiste en el estudio que se realiza con el propósito de desglosar elconcepto de delito en un sistema de categorías, lo que facilita la aplicación de la ley penal a nivel práctico.
Esencialmente la teoría del delito consta de cuatro elementos, que son:
1. Acción u omisión humana
2. Tipicidad
3. Antijuricidad
4. Culpabilidad
Se puede entender que el delito se configura cuando están presentes estos cuatro elementos.
Una vez comprobados los elementos seagrega la sanción o pena que es la consecuencia jurídica. Cada uno de los elementos suele ser objeto de estudio en forma independiente.
La Antijuricidad constituye el segundo gran estadio de la teoría del delito, pero a ella se accede una vez que se ha comprobado que el hecho acusado, efectivamente s subsume en el tipo penal.
