"CONSIDERACIONES SOBRE EL AVOCAMIENTO". El artículo 2 del Texto Constitucional consagra los valores que sustentan un Estado Democrático, de Derecho y de Justicia propugnándolos como valores superiores a suordenamiento jurídico como la vida, la libertad, la justicia, la igualdad, la solidaridad, la democracia, la responsabilidad social y en general, la preeminencia de los derechos humanos, la ética y el pluralismo político. El valor justicia establecido en la Carta Magna, es al mismo tiempo un derecho humano, consagrado en diversas disposiciones constitucionales y una garantía para el Estado de garantizara los justiciables una recta, eficaz y eficiente administración de justicia para obtener resultados tangibles, virtuosos, como es la realización de la justicia; la misma debe ser accesible, expedita, sin dilaciones indebidas, sin formalismos o trabas que la obstaculicen. La hermenéutica jurídica del orden constitucional vigente va a incidir significativamente en la materialización del Estado dejusticia que delineó el Constituyente de 1999. En reciente interpretación de la Sala Constitucional se ha declarado inconstitucional la disposición contenida en el artículo 43 de la Ley Orgánica de la Corte Suprema de Justicia con efectos generales y pro-.futuro en lo que respecta a la facultad de avocamiento establecida en el artículo 42, numeral 29 que solo ha estado atribuida a la Sala PolíticoAdministrativa del Tribunal Supremo de Justicia, en lo sucesivo, será competencia de todas las salas que integran el máximo Tribunal, con consecuencias bien importantes en la administración de justicia. The article 2 of the Constitutional Text consecrate the values that sustaina Democratic State, of Right and of Justice pro-fights like superior values to their juridical classification, as the life, the freedom, the justice, the equality, the solidarity, the democracy, the social responsibility and in general, the pre-eminence of the human rights, the ethics and the political pluralism. The value justice settled down in the Great Letter, is at the same time a humanright, consecrated in diverse constitutional dispositions and a guarantee for the State of guaranteeing to the actionable ones a straight line, effective and efficient administration of justice to obtain tangible results, virtuoso, like it is the realización of the justice; the same one should be accessible, expedite, without undue delays, without formalisms or obstacles that block it. The artificialhermeneutics of the effective constitutional order will impact signifcantly in the materialization of the State of justice that delineated the Constituent of 1999. In recent interpretation of the Constitutional Room it has been declared unconstitutional the disposition contained in the article 43 of the Organic Law of the Supreme Cortrt of Justice with general effects and profuture in what concernsto the ability of the avocament settled down in the article 42, numeral 29 that alone it has been attributed to the Room Politician
