LA REFORMA DEL DERECHO PROCESAL ADMINISTRATIVO FEDERAL DE 2010 Maestro Miguel Pérez López* A mi esposa Luz Elena por veinte años juntos y quince años de feliz matrimonio RESUMEN: La reforma a las Leyes Federal de Procedimiento Contencioso Administrativo y Orgánica del Tribunal Federal de Justicia Fiscal y Administrativa mediante Decreto publicado en el Diario Oficialde la Federación de 10 de diciembre de 2010, constituye un avance considerable de las instituciones del Derecho Procesal Administrativo Federal y que da seguimiento a una cauda dilatada de modificaciones en dicha materia, que dan solidez al Tribunal Federal de Justicia Fiscal y Administrativa, celebrante de sus 75 años al servicio de México. El presente estudio procura dar una primeraaproximación, así sea en forma de esbozo, a la reforma procesal administrativa de muy amplio espectro, en donde destacan tres cuestiones torales: a) la incorporación del Juicio en Vía Sumaria, b) la modificación del capítulo de las medidas cautelares y c) la instauración de un nuevo sistema de notificación de los autos y resoluciones recaídos en juicio contencioso administrativo federal, basado en la víaelectrónica, amén de otras modificaciones de tipo orgánico, procesal y de la creación jurisprudencial. La reforma fortalece el aparato jurídico de una de las instituciones de mayor reconocimiento social del sistema mexicano de justicia administrativa, de inmarcesible prestigio en el foro y colocada en la vanguardia de la construcción del Estado de Derecho. ABSTRACT: The reforms to the Federal Law of Administrative Litigious Procedure and the Organic Law of the Federal Tax and Administrative Court (Tribunal Federal de JusticiaFiscal y Administrativa), through the Decree published in the Federation’s Official Journal on December 10, 2010, constitute a considerable advance in the Federal Administrative Procedural Law Institutions, and follow up on a large amount of modifications on the subject, which bring solidity to the Federal Tax and Administrative Court, which celebrates 75 years serving Mexico. This research tries togive a first approach, even if it is just an outline, to the administrative procedural reform, from a broad spectrum, where three total matters are emphasized: a) the incorporation of a Judgment on Summary Procedure, b) the modification of the chapter on precautionary measures, and c) the implementation of a new notification system for writs and resolutions on federal administrative litigiousjudgment, based in on-line procedures, besides other organic, procedural and jurisprudential creation type modifications. The reform strengthens the juridical apparatus of one of the greatest socially acknowledged institutions in the Mexican administrative justice system, with imperishable prestige in the forum and set on the leading edge of the State of Law’s construction.
