RESUMEN
En la evolución de la teoría del delito, el aspecto
subjetivo, ha sido determinante en el sujeto al
momento decuestionarle una conducta humana
normada legalmente, es decir, aquellas que han sido
prohibidas por la ley penal, o aquellas que establecen
mandatos. Una persona es imputable, cuando tiene
el conocimiento de la ilicitud del comportamiento
y la voluntad dirigida hacía su realización, cuando
esos elementos no concurren, estamos ante una
sujeto inimputable. El inimputable, merece un trato
especial,humano, encaminado a lograr la paz social

y la consecución de una verdadera justicia material.
Desde el punto de vista histórico-jurídico, se encamina
a la búsqueda de nuevos referentes sobre losfactores
que determinan las causas y consecuencias de la
inimputabilidad, que contribuye a mejorar la triádica
relación entre el individuo, el aparato judicial y
la sociedad. Las causales de inimputabilidad en
Colombia son: El trastorno mental, concebido como
toda condición médico-psicológica que afecta las
esferas cognoscitiva y volitiva del sujeto, la inmadurez
psicológica y la diversidadsociocultural o estados
similares; que colocan al individuo en la incapacidad
para comprender la ilicitud de sus actos y determinarse
de acuerdo a esa comprensión, a quien, no se le
impondrá penas, sino medida de seguridad.

ABSTRACT
On evolution of crimine theory, the subjective
aspect has been a determiner on the subject at the
moment of being asked about a human conduct that
is legally directed, in otherwords, those that have
been prohibited by the criminal justice, or those that
establish warrants. Insanity arises when the subject is
not in capacity of understanding the nature of his acts
or to determine his conduct, due to mental disorder
or psychological immaturity.

both cognositive and volitive areas of the subject,
psychological immaturity and sociocultural diversity o
similar states; which place the persons in the inability
to understand the unlawfulness of his acts and

will have safety measures.
