INTRODUCCIÓN
El siguiente trabajo tiene como objetivo comprender diversostemas relacionados con el derecho romano, como ser los derechos reales sobre la cosa ajena, que implican que una persona tenga un derecho real sobre una cosa que pertenece a otro, se clasifican en derechos reales de goce y derechos reales de garantía.
Entre los primeros tenemos a las servidumbres, la enfiteusis y la superficie; los segundos están representados por la prenda y la hipoteca.
Tambiénabarcaremos el tema sobre los derechos reales de garantía los cuales consisten en la prenda y la hipoteca estos son reconocidos como tales por el derecho pretoriano y tienen como origen la fiducia; a través de la cual el deudor, o un tercero, en su nombre, transmitían una cosa al acreedor, para garantizar el pago de una deuda.
