RESUMENEn el presente trabajo se analizará uno de los temas más interesantes del Derecho Internacional Privado: primero, se analiza la nacionalidad, dando un enfoque histórico, en esta parte veremos los cambios de criterio tanto en Roma, donde se reguló por el ius sanguinis; luego en la Edad Media, el criterio se relativiza; y modernamente la nacionalidad la establece el Estado mediante la Ley.

Luego,se busca una definición de la nacionalidad, entendida como la vinculacion a un Estado, de la persona nacida o naturalizada en el mismo; seguidamente, se analizará la naturaleza de la nacionalidad: si es privado o público.

Tambien se tomará en cuenta los modos de adquirir la nacionalidad: el criterio ius sanguinis y el criterio ius soli; tambien se menciona un criterio mixto, dando la eleccióndel cambio de la nacionalidad.

Además se abordarán los principios de la nacionalidad: Todo hombre debe tener nacionalidad, Nadie puede tener más de una nacionalidad, Todo hombre puede adquirir voluntariamente una nueva nacionalidad con el consentimiento del nuevo Estado. Seguido de los conflictos de la nacionalidad, a su vez, se tomarán en cuenta a los apátridas o sin patria.

Por último, seanalizará el caso de Baruch Ivcher, el cual fue resuelto por la Corte Interamericana, donde se verá claramente el abuso del Estado peruano, privándole al señor Ivhcer, de su nacionalidad por diversos intereses.

ABSTRACT

In this paper we analyze one of the most interesting topics related to Private International Law. First, we research the nationality, giving a historical approach. In thispart, we will see changes both in Rome criteria, which was regulated by jus sanguinis; then in the Middle Ages, where the criteria changed and is relativized. Modernly nationality is established by the State through the Law.

Then, we seek a definition of nationality which is understood as link to a State for a person that is born or naturalized in it. Next, we will analyze the nature ofnationality, whether it is private or public.

Also we will take into consideration the types of acquiring citizenship: ius sanguinis and jus soli. On the other hand, we mention the mixed type, giving the choice of changing nationality.

It is also addressed the principles of nationality: Every man should have a nationality, no one shouldcan have more than one nationality, every man can voluntarilyacquire a new nationality with the consent of the new State. Then, the conflicts of citizenship; we will take into account the stateless or homeless.

Finally, we will analyze the case of Baruch Ivcher which was resolved by the Interamerican Court of Justice, because it became a clear abuse of the Peruvian State to deprive Mr. Ivcher of their nationality for an economic interest.

El tema que hemos elegido para la realización del presente trabajo es la Nacionalidad, un tema que aparentemente no existe mayor complicación, sin embargo, si profundizamos en ella, nos daremos cuenta, que este vinculo que puede tener una persona con un determinado Estado, puede ser fuente de innumerables...
